This document contains the Deposit Account Agreement and the federal regulatory disclosures applicable to UBANLC BANK (N.A.) deposit accounts and card services. It is incorporated by reference into the Terms of Service.
1. Member FDIC — insurance disclosure
UBANLC BANK (N.A.) is a Member FDIC. Deposits are insured by the Federal Deposit Insurance Corporation up to at least $250,000 per depositor, per insured bank, for each account ownership category, as described in FDIC regulations. Deposit insurance coverage does not apply to non-deposit products such as credit card balances. For details, visit fdic.gov or request FDIC brochure “Your Insured Deposits.”
2. USA PATRIOT Act and Customer Identification Program (CIP) notice
IMPORTANT INFORMATION ABOUT PROCEDURES FOR OPENING A NEW ACCOUNT: To help the government fight the funding of terrorism and money laundering activities, federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. What this means for you: when you open an account, we will ask for your name, address, date of birth (for individuals), Tax Identification Number (SSN/ITIN or EIN/FEIN), and other information that will allow us to identify you. We may also request supporting documents, such as a driver’s license, passport, or, for businesses, formation documents and beneficial-ownership information. We may decline to open an account or take other action when the required information cannot be verified.
3. Funds availability (Regulation CC)
Our general policy is to make funds from your deposits available according to the following schedule, subject to holds described below: internal UBANLC transfers are generally available immediately; ACH credits are generally available on the business day we credit them; check deposits are generally available no later than the second business day after the day of deposit, with the first $225 available the first business day; wire and SWIFT credits are generally available the business day received. Longer holds may apply for new accounts (first 30 days), large or repeated deposits, redeposited checks, reasonable doubt of collectibility, emergency conditions, or when we have a reasonable belief a check is uncollectible. We will disclose any extended hold as required by Regulation CC.
4. Electronic fund transfers (Regulation E) — consumer summary
For consumer accounts, Regulation E governs electronic fund transfers. You may stop payment on preauthorized transfers by notifying us at least three business days before the scheduled transfer date. We will investigate reported errors and, where an error is confirmed, correct it within the timeframes of Regulation E (generally within one business day for point-of-sale or foreign-initiated transfers after we learn of the error, and within ten business days otherwise, with provisional credit and up to 45 days for extended investigations with written notice). Your liability for unauthorized transfers is limited as provided in Regulation E, provided you report promptly: up to $50 if reported within two business days, up to $500 if reported after two business days but within 60 days of statement availability, and unlimited for transfers not reported within 60 days. Business accounts are excluded from Regulation E; see the Terms of Service for business error-reporting deadlines.
5. Unlawful internet gambling notice (Regulation GG)
Restricted transactions as defined in Federal Reserve Regulation GG are prohibited from being processed through this account or in any relationship with us. A restricted transaction is a transaction in which a person accepts in connection with unlawful internet gambling credit, funds, instruments, or the proceeds of any of these. If you engage in restricted transactions, we may terminate the relationship.
6. Equal Housing Lender
We are an Equal Housing Lender. We do business in accordance with the Federal Fair Housing Law and the Equal Credit Opportunity Act. We do not discriminate on the basis of race, color, religion, national origin, sex, marital status, age, familial status, disability, or the exercise of any right under the Consumer Credit Protection Act.
7. Truth in Savings (Regulation DD) and rate disclosures
Rate information, annual percentage yields (APY), minimum balance requirements, and compounding and crediting frequency applicable to each savings product are disclosed at account opening and are available on request. We may change rates at any time; for variable-rate accounts, the rate and APY may change after the account is opened. Fees may reduce earnings on the account.
8. Fees and charges
The following fixed processing fees apply to inbound deposits by payment rail and are deducted at posting: ACH/bank transfer $18.60; wire $30.00; SWIFT $70.00; check $15.00. Additional fees (card issuance or replacement, expedited delivery, dormancy, paper statements, returned items, legal process) are disclosed in the Fee Schedule provided at account opening. We may amend the Fee Schedule in accordance with the Terms of Service.
9. Dormant and inactive accounts; escheatment
Accounts with no customer-initiated activity for the period specified in the Fee Schedule may be classified as dormant and assessed a dormancy fee. After the statutory period of inactivity, funds may be escheated (transferred) to the state of your last known address as required by state unclaimed-property law. You may reactivate a dormant account by contacting us before escheatment.
10. Order of posting, setoff and account liens
Transactions are posted in the order received and processed. You grant us a security interest in and contractual lien on all deposits as collateral for any debt you owe us, and we may exercise setoff as described in the Terms of Service, to the extent permitted by law and without requiring prior notice where notice is waived or prohibited.
11. Card terms
Debit and credit cards are issued subject to the applicable cardholder agreement provided at issuance. You agree to the daily limits disclosed for each card product, to report lost or stolen cards immediately, and to review card activity promptly. Visa and Mastercard are registered trademarks of their respective owners; network terms may provide additional dispute rights, which do not modify this Agreement.
12. Complaints and regulator contact
If you have a complaint, contact Customer Care first so we may resolve it. You may also contact the Consumer Financial Protection Bureau (consumerfinance.gov) or your state banking regulator. Nothing in this Agreement limits your right to contact a regulator or file a complaint with any government agency.
